Contractual terms governing use of ARIA consumer and institutional surfaces.

These Terms of Service ("Terms") govern access to and use of ARIA's services. By creating an account, accepting an invitation, or signing a DPA, you agree to be bound by these Terms.
1. Services
ARIA provides real-estate advisory and institutional underwriting software. Services are provided on a subscription basis (consumer free through Preview + Beta; institutional under a signed order form).
2. Advisory posture
ARIA is not a brokerage, not a bank, and does not hold client funds. All advisory outputs are informational unless your tenant has an active SAMA/CMA opinion and we explicitly operate under an advisory posture (see business_config.sama_posture and our Advisory Disclaimer).
3. Your obligations
- Keep your credentials confidential; use MFA where available
- Provide accurate profile and project inputs — ARIA cannot verify external data
- Do not reverse-engineer the platform or circumvent tenant isolation
- Respect Saudi law and regulator guidance in your use of the outputs
4. Data + security
Our Privacy Policy and Security overview describe how we handle your data. In case of conflict, the Privacy Policy governs. Institutional tenants execute a DPA (BRP-07) before live use.
5. Fees + taxes
Retail is free through Preview + Beta. Institutional fees are as stated in your order form. From Live, we invoice per ZATCA e-invoicing rules with VAT at statutory rate.
6. Term + termination
- You may close your account at any time from Settings → Account
- We may suspend for payment failure (institutional), ToS violation, or regulator direction
- Audit chain is preserved per our retention schedule even after termination
7. Warranties + liability
Services are provided "as-is" during Preview and Beta. Live SLAs are stated per order form. Liability is capped at 12 months of fees paid for institutional tenants; for free retail users liability is limited to the maximum extent allowed by law.
8. Governing law
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes are subject to KSA courts unless your order form specifies arbitration.
9. Changes
Material changes to these Terms trigger a version bump and a re-consent modal. Your continued use after the effective date constitutes acceptance.
